Court’s submission to the Steering Committee for Human Rights on its case law on immigration matters

Court submitted a brief and objective overview of the current state of its case law on immigration, as a contribution to the work of the Steering Committee for Human Rights (CDDH). The CDDH was tasked with preparing draft elements for a political declaration, as a follow-up to the decisions adopted by the Ministers’ Deputies at the Informal Ministerial Conference held in Strasbourg on 10 December 2025.

The document outlines the Court’s jurisdiction, its approach to and review of such cases, the scope of rights protection, and the principle of subsidiarity and shared responsibility. It also highlights the Court’s centralised examination of immigration cases, provides statistics, and includes an annex listing Grand Chamber judgments and decisions on immigration delivered since 2020.
