In the case of Tuleya v. Poland the Court held that there had been multiple violations of the Convention.

The case concerned the disciplinary regime for judges in Poland. The case originated in an application lodged by a well-known judge who had five sets of preliminary inquiries initiated against him in 2018 on suspicion of disciplinary misconduct. One of those inquiries had led to the lifting of his immunity from prosecution, and suspension from his official duties for over two years. The Court emphasised that the applicant’s case had to be seen in context, notably that he was one of the most outspoken critics of judicial reform in Poland.
