Interim measures in case of Shamayev and 10 others v. Georgia and Russia
On the evening of Friday 4 October 2002, the Court received a preliminary application from 11 Chechens, Shamayev and 10 others v. Georgia and Russia (application no. 36378/02).
The applicants allege that an extradition request from Russia to Georgia concerning them was about to be granted and implemented which, in their view, would result in breaches of their rights under Articles 2 (right to life) and 3 (prohibition of torture and inhuman or degrading treatment and punishment) of the European Convention on Human Rights. They asked the Court to apply Rule 39 of the Rules of Court to prevent extradition.
The Vice-President of the Second Section of the Court, to which the case was allocated, decided to indicate to the Government of Georgia, under Rule 39, that it was desirable in the interests of the parties and the proper conduct of the proceedings before the Court not to extradite the applicants to Russia, until the Chamber had had an opportunity to examine the application in the light of the information to be provided by the Georgian Government concerning the basis of the extradition and the detention measures planned by the Russian Government. The application was also notified to the Russian Government under Rule 40 of the Rules of Court.

The European Court of Human Rights was set up in Strasbourg in 1959 to deal with alleged violations of the 1950 European Convention on Human Rights. On 1 November 1998 a full-time Court was established, replacing the original two-tier system of a part-time Commission and Court.
