Grand Chamber judgment concerning Romania

In the case of Nicolae Virgiliu Tănase v. Romania, the Court has found no violation of the Convention. The applicant, a judge who was seriously injured in a road-traffic accident in 2004, complained, in particular, about the length and alleged ineffectiveness of the criminal investigation into the accident.

The Grand Chamber took the opportunity to clarify which Articles of the European Convention on Human Rights should be applied in the case of an accident causing severe injury. Thus, although the applicant had relied essentially on Article 3 (prohibition of inhuman or degrading treatment), the Court considered it appropriate to examine the case also under Articles 2 (right to life) and 8 (right to respect for private and family life).

    In the case of Stoian v. Romania, the Court has held that there was no violation of the Convention.

    The applicants, a mother and her wheelchair-bound disabled son, submitted that he had not had adequate access to education.

    The Court held that Romania had taken sufficient measures to ensure reasonable accommodation for the educational needs of children with disabilities.

  • Judgment concerning Croatia

    In the case of A and B v. Croatia, the Court found no violation of the Convention.

    The applicants, a mother and daughter, accused the Croatian authorities of having failed to take appropriate action on their allegations of sexual abuse of the little girl.

    On 24 June 2019 the Court accepted the referral to the Grand Chamber of the cases of X and Others v. Bulgaria and Albert and Others v. Hungary. The Court also decided to reject requests to refer 13 other cases.
